Our practice includes first mortgage loans, mezzanine loans, construction loans, conduits and CMBS to various legal entities including traditional borrowers, REITS, pension funds and Real Estate Separate Accounts.
Loans are secured by a myriad of property types including apartments, hotels, office buildings, low income housing, retail developments, subdivisions, and industrial properties. In addition, we regularly represent parties involved in multi-lender and multi-state transactions.
We have significant experience representing national, regional and local landlords and tenants in lease negotiations and disputes. We have significant experience in sophisticated leases in regional malls, multi-tenant mixed use office buildings and single-use facilities. Our expertise includes drafting and negotiating leases, ground leases, subordinations, guarantees, expansions, renewal rights, subleases, assignments, amendments, releases, sale-leasebacks, and terminations. We also negotiate and litigate issues and disputes regarding lease terminations, evictions, constructive evictions, and bankruptcy filings. We have routinely reviewed leases on behalf of financing institutions including an analysis of the mortgageability of ground leases, a review of credit tenant leases and a general review of leases for financing and security purposes.
